Tips And Advice On Informal Family Law Arrangements

Many people are unaware that informal arrangements about child custody, child support, and spousal support are not enforceable in Wisconsin courts.

If you lose your job and are temporarily unable to make child support payments, for example, your children’s other parent may informally agree to let you suspend support payments temporarily.

However, the State of Wisconsin will not.

You are required to continue making the same payments until you receive a modification in the court-ordered child support; this modification can occur either by a written stipulation and approval by the court, or pursuant to a court order following a hearing. Without a legal modification of support, you will be in arrears on your child support obligation. You will be held responsible for all back child support plus 12 percent interest.

Tips And Advice on Representing Yourself

Many people choose to represent themselves in their family law or divorce case, which the court refers to as a pro se party.  In that instance, you are your own advocate.  There can be many reasons why someone would choose to represent themselves such as both parties agree not to hire lawyers and work it out themselves, not wanting to drag personal issues out into court in a trial, and wanting to keep costs reduced. 

We see many individuals that come to us after their case is completed to see if we can fix a mistake that was done before a judgment was entered.  Issues such as division of retirement accounts can be complicated.  Additionally, statutes govern how parties can change placement or child support after an order has been entered and what grounds need to be met before a change can even be considered.  In general, you have many more options, and pursuing these options is often significantly less expensive, if we address the issues fully before judgment is entered rather than trying to fix what has already been done.
