Am I Entitled to an Appeal?

Appeals are typically granted when the court is convinced that the appellant did not receive a fair trial due to procedural or legal errors on the part of the presiding judge. In general, grounds for an appeal may involve:

  • Procedure: Failure to follow proper courtroom procedures can compromise fairness of a trial. Some of these include not allowing one party time for rebuttal, improper exclusion of tainted evidence (including testimony) and improperly instructing the jury. Additionally, failure to properly instruct the jury can also compromise the procedural fairness of a trial.
  • Evidence: Misinterpreting or misapplying hearsay rules, discovery rules or evidentiary requirements can result in prejudicial testimony and tainted evidence. For example, evidence that has not been properly secured or tested may not be fit for introduction at trial. Failure to properly follow rules of evidence can result in the mistaken inclusion or exclusion of testimony and physical evidence.
  • Application of the Law: During a trial, a judge may be required to rule on points of law. For example, legal questions may arise regarding whether or not the statute of limitations applies, whether someone has been indemnified, or whether or not someone's job responsibilities make them a fiduciary. Failure to properly interpret legal principles and rules can compromise the fairness of a trial as well.
